Terms and Conditions


These are the Terms and Conditions that regulate the contractual relationship for the purchase of products that BE.GREEN PLANT DESIGN AND CARE, S.L. offers in its online shop.

The Terms and Conditions of sale described below exclusively govern the contractual relationship between any user of the BE.GREEN PLANT DESIGN AND CARE, S.L. website (hereinafter referred to as "Customer") and the seller, which is the company BE.GREEN PLANT DESIGN AND CARE, S.L. (hereinafter referred to as "Be.Green" or also as "We") and owner of the online shop: www.be.green with registered office at Carrer de Frederic Mompou 3, 08960, Sant Just Desvern, Barcelona, with Tax Identification Code number B02715225.

1. Subject matter

1.1. The purpose of these Terms and Conditions of Purchase is the supply by Be.Green of the products offered in its Online Shop, in exchange for an economic benefit.

2. Commencement

2.1. These Terms and Conditions, together with your order confirmation, constitute the contract between Be.Green and the Customer for the supply of products. No other Terms and Conditions shall apply.

2.2. The Customer shall be deemed to have agreed to the general terms and conditions set out in this text from the moment he/she accepts that he/she has read and agrees to these Terms and Conditions.

3. Placing an order

3.1. In order to place an order, the Customer must be at least 18 years old.

3.2. The Customer must complete the entire purchase process and make the payment with any of the systems that the site provides.

3.3. When the Customer places his/her order, we will send him/her an order number.

3.4. By placing an order, the Customer is making us an offer to purchase the products he/she has selected in accordance with these Terms and Conditions. BE.GREEN PLANT DESIGN AND CARE, S.L may or may not accept your offer.

3.5. If we accept your order, we will notify the customer of our acceptance by issuing an order confirmation. We will send your order confirmation by e-mail, provided that you have provided us with your e-mail address in your personal data form.

3.6. Although we will make every effort to supply you with the products listed in your order confirmation, there may be occasions when it is impossible for us to supply such products due to, for example, such products being out of stock. In such cases we will contact you to inform you and may suggest alternative products that you may wish to purchase. If you do not accept our suggestions we will cancel your order in relation to the products we are unable to supply and refund any monies paid to us for such products. The refund of these sums of money will be the limit of our liability to you in the event that it is impossible for us to supply you with the products ordered. Very occasionally, the prices of the products shown in our Online Shops may be incorrectly specified and show a lower price than the corresponding price due to an error. When this happens and, if we have confirmed your order, we will contact you immediately in order to issue a new order confirmation with the correct price. In the event that the correct price is significantly higher, you may cancel your order and we will refund any amount you have already paid.

4. Delivery of your products

4.1. We will supply you with the products indicated in your order confirmation in accordance with these Terms and Conditions.

5. Product Information

5.1. We pay great attention to the information concerning the essential characteristics of the products by means of technical descriptions from partner companies and photographs illustrating the products. All this is done within the limits of technology and in compliance with the best market standards.

6. Prices

6.1. The price of each product will be clearly stated on the website. The price and conditions of the products offered may vary, but in any case always govern for the Customer the price and conditions that existed when the order was placed.

6.2. We reserve the right to charge the order from the time of receipt.

6.3. The sales prices indicated in our Online Shop are shown as follows:

All prices include VAT.

6.4. The shipping service costs are not included in the price of the products. Shipping service charges are to be borne by the Customer and will be added to the total amount of the selected products. You will be informed of these costs before confirming the order and finalizing the order process.

6.5. We reserve the right to change our prices at any time. However, we undertake to apply the rates in force indicated on the portal at the time the order is placed by the Customer.

7. Availability

7.1. It should be noted that orders will be dispatched within the limits of available stock. If one of the items ordered is not in stock, we undertake to contact the Customer as soon as possible (from the date on which the order was placed) to inform him/her of the period within which we will be able to send his/her product(s). If you are not interested in waiting, you may request a refund of the amount paid for the item(s).

8. Payment of the products

8.1. Be.Green has partnered with Stripe, Google Pay, Paypal, Amazon Pay and Apple Pay to ensure maximum payment security. When you see the Stripe, Google Pay, Paypal, Amazon Pay or Apple Pay symbol, the Customer can consider their transaction to be 100% protected.

8.2. If our security department suspects any anomaly or fraud, Be.Green reserves the right to cancel the transaction for security reasons.

8.3. Be.Green offers the Client 2 payment methods:

  • If you choose to pay by credit card, the Customer's order cannot be taken into account and will not be processed until the payment has been authorised by your bank or cashier. Online payment by credit card is made through the "Secure Socket Layer" security system, which encrypts your bank details when they are transmitted over the internet. For security reasons, Be.Green verifies all orders paid by credit card. We accept American Express, Maestro and any Visa and MasterCard cards registered in the Verified by Visa secure payment system.

8.4. In the event that the purchase has been made by a final consumer or a company, the corresponding invoice may be requested. Both will contain the breakdown corresponding to Value Added Tax if applicable and shipping costs.

9. Delivery of the products

9.1. We will send the Customer their products to the delivery address given in their personal data form.

9.2. On the website, specifically in the shopping basket, the amount of shipping costs is indicated before the purchase is made.

9.3. If the article indicates "in stock" when placing the order, the time between placing the order and the delivery date will be 3/5 working days from our validation of the payment received, as the products come directly from the nurseries and, different products, will have different nurseries as origin. We deliver from 9am to 8pm. If the article is not in stock at the time of placing the order, we will contact the customer to inform him/her accordingly. Estimated delivery times are for orders placed on the peninsula. We do not deliver to the Balearic Islands, Canary Islands, Ceuta or Melilla.

9.4. We will deliver the product once it has been verified that the effective realization of the payment has been executed correctly.

9.5. We understand the hours and days as working hours and days, excluding Saturdays and Sundays and holidays. If for any reason attributable to Be.Green this period is exceeded, we will inform the Client of the incident and propose alternative solutions.

9.6. The Client undertakes that he or another designated person is at the address indicated to receive the package. In case of not being there the first time, the carrier will insist one (1) more time. If the order still cannot be delivered, it will be returned to us, and the Client must contact Be.Green to request a refund minus the cost of shipping or return of the goods, which will be borne by the Client.

9.7 The delivery address can be changed when the order is not yet being processed. Go to your user area, click on the order you wish to change and edit the delivery address. If the option to change the address does not appear, it means that the order is already being processed and probably can no longer be changed, but please contact us in the chat so that we can check this for you.

10. Product Warranty

10.1. All products offered by Be.Green are guaranteed. We undertake to replace with a new one or make the corresponding credit if any of its products suffer from a manufacturing defect within 7 days of delivery.

10.2. The consumer must inform us of the non-conformity of the product within 7 days of becoming aware of it by contacting us through the form explaining that he/she wishes to return a product and attach a photo. In this way, we will organize the return in the most suitable way. In the event that the problem of the product is not under warranty, the consumer will pay any additional costs arising from the return of the product.

12. Obligations of Be.Green and the Client

12.1. Be.Green undertakes to make available to the Client all necessary information regarding the products offered and orders. Be.Green is not responsible for the non-execution of these conditions in case of force majeure or an unforeseeable event either by the Client or by a person outside the contract.

12.2. The Client undertakes to fill in the order forms and their fields according to the instructions indicated. Be.Green will protect the data in accordance with the law. The Client also undertakes to pay the price of the product, with the corresponding taxes and shipping costs.

12.3. We remind you that it is advisable to keep a copy of the data contained in the products purchased. Be.Green is not responsible for any loss of data, files or, in general, any damage resulting from a failure by the Client to back up the data contained in the products purchased.

12.4. Be.Green is not responsible for the consequences that may result from improper use of the products sold in its Online Store.


All reviews written by Customers are checked by the marketing team. If the reviews received infringe the law, ethics or morals (abusive advertising, defamation, insults, comments out of context...), Be.Green reserves the right to refuse or request a review of such reviews.

14. Protection of personal data

14.1. The personal data to be provided by the Customer are essential for the dispatch of orders and the drawing up of invoices. Failure to provide this information will result in the automatic cancellation of orders. By registering on the site, the Customer agrees to provide valid personal data, data that allow the provision of the service by Be.Green and the correct identification of the registered Customer, as well as sending information and advertising of different products and offers that Be.Green may have on their websites.

15. Intellectual Property

15.1. All content of the Be.Green Online Shop and its Blog (illustrations, texts, names, trademarks, images, videos) is the property of Be.Green. Any partial or total reproduction of the content by any process and on any medium whatsoever is subject to prior express authorisation from Be.Green.

16. Applicable law and jurisdiction

16.1. This contract shall be interpreted and governed by the Spanish and European legislation in force.

16.2. These General Conditions are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user's domicile.

17. Concerning promotions and coupons

17.1. All promotions and coupons have an expiry date of one month if the promotion does not specify otherwise.

17.2. Promotions that are discount coupons, always apply solely and exclusively on the value of the product.

17.3. Promotions that are discount coupons, always have a minimum amount to be consumed, which in the case of not being specified will be calculated at 29 € for all promotions.

17.4. Be.Green reserves the right to cancel a promotion to that person who makes an incorrect use of it, or that under different identities acquires numerous units of the promotion.

18. Modifications to the General Conditions

Be.Green reserves the right to modify, at any time and without prior notice, the presentation and configuration of the website, as well as the General Conditions of Use. Customers will always have these General Conditions in a visible place, freely accessible for any queries they may wish to make. Customers should read these General Conditions of Use carefully each time they access the website. In any case, the acceptance of the General Conditions of Use will be a prior and indispensable step to the contracting of any service available through the website.

19. Subscriptions

Be.Green offers the possibility to subscribe with a 5 euro discount. Under no circumstances may discounts be accumulated together with a subscription.

20. Promotion help us to fill the world with green

Once the plant has been received, the Customer must post a photo of the plant on their instagram feed and contact Be.Green on the Instagram corresponding to their country to request the 15% discount applicable only to the second purchase, which must be made within 30 days after the first purchase.

Only one participation per natural person is allowed. Legal entities are not allowed to participate.

21. Modify billing address

You can do this by logging into your Be.Green Club user area and opening the order you wish to change.

22. Cancellations

You can make changes when the order is not yet being processed. Log in to your user area and click on the order you wish to cancel. If you do not see the option to cancel it means that the order is already being processed and probably cannot be cancelled, but please contact us in the chat so we can check it for you.
